It seems like the Nike legal team is, once again, putting in the extra hours! Mind you, this isn’t the first time that the Swoosh took another brand to the court. You can check out the legal drama here! This time, Skechers and New Balance got the short end of the stick. And the reason behind the lawsuit is Nike’s revolutionary Flyknit technology! So, let’s dive into what will go down between the brands, in addition to some previous similar lawsuits. Shall we?
Well, it seems like the legal saga is in full swing this time. Nike’s legal team hit New Balance and Skechers with separate lawsuits over Flyknit patent infringement. It’s worth noting that Nike owns multiple patents for the Flyknit material since September 2012. Now, in 2023, the Swoosh says that New Balance infringed the patent. Some of the sneakers in question are the NB Tekela, FuelCell, and Fresh Foam.
On the other hand, Skechers is facing a second lawsuit from Nike; the first one was back in early 2016. According to the Swoosh, there are dozens of models that infringe the Flyknit patent. Some of those silhouettes are Skechers Glide Step and Slip-in Ultra Flex 3.0. Now, in both lawsuits, Nike asked for damage rewards. In other words, the legal team is after the bag!
So New Balance now joined the ranks of many brands that faced the same lawsuit. Obviously, we have Skechers, twice, with Adidas and Puma. However, Puma settled the lawsuit with Nike in 2020 while Adidas did it in 2022. Oh, and in January 2023 Nike sued Lululemon for the same reason, a lawsuit that remains open today. Ironically, the Swoosh didn’t specify an amount of money, which kinda leave space for negotiation! So, let’s wait and see how all that drama unfolds.
